These Terms of Service (“Terms”) cover the website design and digital services provided by Feltz Digital (“we,” “us,” or “our”), based in Germantown, Maryland. By hiring us for a project or using one of our services, you (“you” or “the client”) agree to these Terms. We’ve written them in plain English so everyone knows what to expect.

The services we provide

Feltz Digital builds and supports websites for small businesses and nonprofits. Depending on what you need, that can include website design and development, redesigns, WordPress setup, local SEO basics, hosting guidance, and ongoing website care. The exact work, deliverables, and price for your project are set out in the quote or proposal we provide before we begin.

Quotes, payment, and deposits

We’ll give you a written quote or proposal for your project. Unless your proposal says otherwise, a deposit is due before work begins, with the balance due before your site goes live or is handed over. Ongoing services (such as care plans or hosting) are billed on a recurring basis as described in your agreement. Payments already made are generally non-refundable once work has started, except where required by law.

Project scope, revisions, and timelines

Each project includes the scope and number of revision rounds listed in your proposal. Work beyond that scope is welcome but may affect the timeline and cost, and we’ll talk it through with you first. Timelines depend on both of us: to keep your project moving, we’ll need content, feedback, and approvals from you within a reasonable time. Delays in receiving these may push back your launch date.

Your content and responsibilities

You’re responsible for the text, images, logos, and other materials you provide, and you confirm you have the right to use them. Please don’t send us anything that infringes someone else’s copyright or trademark, or that’s unlawful. We’re not responsible for content you supply, and you agree to hold us harmless from claims related to it.

Ownership and handoff

We believe you should own your website. Once your project is paid in full, the final website and the content you provided are yours. You’re free to host, edit, and move your site wherever you like — we don’t lock you in. Any third-party themes, plugins, or stock assets remain subject to their own licenses.

Website care plans and ongoing support

Care plans and ongoing support are optional and month-to-month unless agreed otherwise. You can cancel with reasonable notice as described in your plan. If a care plan ends, you remain responsible for your own updates, backups, and security going forward.

Third-party services

Your website may rely on third-party services such as web hosting, domain registrars, plugins, and email providers. These are provided by other companies under their own terms, and we don’t control their pricing, uptime, or policies. We’ll help you choose sensible options, but we aren’t responsible for outages or changes on services we don’t operate.

What we can and can’t promise

We take pride in our work and will always do our best for you. That said, we can’t guarantee specific business outcomes such as search engine rankings, traffic numbers, or sales — these depend on many factors outside our control. Our services and any guidance we provide are offered on an “as is” basis without warranties of any kind, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Feltz Digital’s total liability for any claim related to our services is limited to the amount you paid us for the specific project or service involved. We’re not liable for indirect, incidental, or consequential damages, including lost profits or data.

Ending a project or agreement

Either of us can end a project or ongoing service with reasonable written notice. If you cancel a project already underway, you’re responsible for payment for the work completed up to that point. We may pause or stop work on overdue accounts.

Changes to these terms

We may update these Terms from time to time. The current version will always be posted on this page, and the date below shows when it was last updated. Continuing to work with us after changes are posted means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Maryland.
